Dell Server ProSupport 4-hour Onsite Guarantee for U.S. Small and Medium Business
For a limited time and subject to the terms of your ProSupport service agreement located at http://content.dell.com/us/en/enterprise/d/services/service-contracts.aspx, Dell will offer a 4-hour onsite service arrival guarantee (“Guarantee”) for all Dell-branded server hardware products when the customer purchases a 3-Year ProSupport contract with either Mission Critical 4HR 7x24 Onsite Pack or 4HR 7x24 Onsite: Non Mission Critical (“ProSupport 4-hour Service Contract“) from Dell U.S. Small and Medium Business Sales:
How the Direct Sales Guarantee Works:
During the 3-year term of the ProSupport agreement, Dell will refund the price of the 4-hour Onsite Service option, excluding taxes, for the applicable asset/service identification number (“Service Tag”) if a service technician fails to arrive within 4 hours after completion of telephone based troubleshooting and a determination by Dell that resolution requires dispatch of a technician to the customer’s site.
The Guarantee will only be applicable to eligible ProSupport 4-hour Service Contracts purchased between April 30, 2011 and July 29, 2011 (“Offer Period”) , subject to earlier discontinuation of this offer by Dell in its sole discretion.
The Guarantee is available for all Dell-branded server hardware products purchased from Dell Small and Medium Business U.S. Sales (“Eligible Products”) .
Each customer is entitled to only one refund per Service Tag for the life of the covered product.
The refund will usually be processed within sixty (60) days from approval date. The refund will be distributed in the same form as the original payment was received (e.g. credit card payment will refund to same credit card account number). Refund does not include the cost of the Dell 3-year Basic Hardware Warranty Repair service contract that is included in the Dell-branded server hardware product’s original price or the cost of the Eligible Product.
Customer must provide the Service Tag, service case number, product SKU as listed on invoice, and any other information as requested by Dell. Dell will verify that customer’s product is an Eligible Product covered by a ProSupport 4-hour Service Contract purchased during the Offer Period.
Dell will review the service case and determine, at Dell’s sole discretion, if a refund is in order.
Customer will be notified within approximately two weeks if a refund will be issued.
This Guarantee covers arrival of the technician within the applicable four-hour response time after completion of telephone-based troubleshooting and a determination by Dell that resolution requires dispatch of a technician to the customer’s site. Dell does not guarantee that a customer’s issue will be resolved within four hours, or at all. The Guarantee is effective as of the date of the packing slip, invoice, or receipt for the applicable Eligible Product.
The Guarantee will not apply if the customer reschedules the service appointment.
The Guarantee is only applicable during the term of the ProSupport 4-hour Service Contract purchased during the Offer Period, and will not be extended due to Dell’s repair or replacement of a warranted Eligible Product or any parts thereof.
Dell may change the availability or terms of the Guarantee at its discretion but such changes will not be retroactive.
Dell shall not be liable to you for any failure to perform any of its obligations under this Guarantee during any period in which such performance is delayed by circumstances beyond its reasonable control including, but not limited to, fire, flood, war, embargo, strike, riot or the intervention of any governmental authority (a "Force Majeure").
