CARTA ABERTA A DELL
OPEN LETTER TO DELL
Sirs:
I bought a Dell Inspiron laptop a little over two weeks ago,
It happens that only after the purchase, the user notices some small things that in the near future could make a lot of difference.
Starting with the Windows 8 installation DVD, which does not come with the product. But since it's under warranty, there's no worries at the moment.
The concern is with the future: if there is an eventual IRREPAIRABLE loss of the hard drive, which requires its replacement or formatting, and the warranty has expired.
Dell is NOT CLEAR at all on this crucial and decisive point: what will the future look like, when the warranty expires?
I see there is an application called Dell Backup and Recovery that has "system backup" and "system recovery media" options.
And this is where the lack of clarity begins. The devil lives between the lines. The subject takes the equipment home and only then, after searching the notebook in detail, does he verify that with the "system recovery media" you can only recover the original HD of the equipment or if it is another HD provided by Dell.
Dell Backup and Recovery does not recognize a third party HDD, only the Dell one. Dell support informed me via chat (I have this recorded) that Dell "injects" the product key into the motherboard, HD and processor, and then none of these three components can be replaced, because will work, as they will not be recognized, unless purchased from Dell itself, who have the key injected.
In other words, ENDING THE WARRANTY, the user is HOSTAGE to the manufacturer, that is, if he needs to, he will not be able to use any of their components, preferably only those from Dell.
I even think that the situation is very similar to the so-called "matched operation", a hateful practice and prohibited by the consumer protection code, that is, you buy the Dell equipment, as I did, but if, after the warranty, you need to change the HD , you must, obligatorily, buy the one from Dell, otherwise the computer will not work. Now, does the subject own what he buys (the windows license and the notebook)? Can you or can't you do what you want with what's yours?
I found this attitude very strange, because since the purchase, at no time was I notified or made aware of this unfavorable condition for the consumer. Neither in the shop window, nor in advertising leaflets, nor by the seller. Anything. There is not a single line, visible to the consumer, before purchase, that informs, or at least indicates, that the product has this UNDESIRABLE condition. Definitely, this relevant and decisive information does not appear and never appeared anywhere before the purchase. And, according to the law, it should be stamped, clearly visible, so that the user can see, BEFORE THE PURCHASE, and decide whether or not to purchase.
Law 8078 of 09/11/90, called the Consumer Defense Code, which regulates relations between suppliers and consumers, in its Art. 18, holds the product supplier responsible for repairing, among other things, the disparity of the advertising message. Later, in its Art. 37, § 1, says that "Any type of information or communication of an advertising nature, wholly or partially false, or, in any other way, even by omission, capable of misleading the consumer regarding the nature, characteristics, quality, quantity, properties, origin, price and any other data about products and services". And even in this same article, in § 3, it says that "For the purposes of this code, advertising is misleading by omission when it fails to inform about essential data of the product or service".
And, among other provisions of this Law, its Art. 66 provides for a fine and imprisonment (DEPRIVATION OF LIBERTY), for anyone who makes a misleading statement about the nature, characteristic, quality, performance of products or services.
I believe that there may even be some misunderstanding, because as Dell is a serious company, recognized worldwide, with great credibility and, above all, abiding by the law, it would not commit such a mistake.
I do not intend to cause, in any way, any kind of embarrassment to Dell, which I also value, and from which I use products.
On the other hand, I could not fail to register my discontent.
Certain that the company will certainly manifest itself on the subject, thank you in advance.

Realmente é algo complicado, uma empresa grande no setor de PCs efetuar este tipo de procedimento, mas infelizmente não é só a Dell que está praticando este tipo de ato. Todas as outras empresas que estão vendendo seus equipamentos com o Windows 8 adotaram isso de injectar o serial no HD, Mother e Processador, o que significa que se for comprar algum equipamento com o windows 8, você estará preso ao fabricante que escolher.

Olá LUIZ-AC,
Esta informação que lhe foi passada, infelizmente não está correta. Caso vc tenha necessidade de trocar seu HD (estando ou não em garantia, sendo ou não a peça fornecida pela Dell) a imagem que vc irá criar através do Software Dell Data Safe Local backup funcionará sem problemas para carregar o seu Sistema Opercional WIndows 8.
Esta imagem não funcionará em outro equipamento que não o seu. Essa informação sim está correta, pois há vínculo direto entre a BIOS do seu equipamento e a sua licença do Sistema Windows 8.

Caro Charles Jean:
Fico muitíssimo grato pela sua demonstração de boa vontade e presteza no esclarecimento.
Só que o link que você me indica mostra a criação de imagem do Windows 7, e ainda assim, com o aplicativo Dell Data Save, ao passo que, como informei, meu SO é o Windows 8, e o aplicativo que vem instalado no notebook é o Dell Backup and Recovery, qual seja, estamos falando de coisas distintas. Creio que você deva ter uma resposta para o mesmo assunto que me refiro
A informação do Suporte Dell pode até estar errada, mas foi isso que estranhamente me informaram, e ainda depois me enviaram por e-mail toda a conversa do chat. Consta lá a etiqueta de serviço que informei em minha mensagem anterior.
Então, para sanar definitivamente a dúvida, responda-me por favor:
1- A Dell "injeta" a chave do produto na placa mãe, no HD e no processador?
2- Qual a finalidade desta chave injetada?
3- Se eu substituir o HD por outro fabricado por terceiros, a imagem do sistema (windows 8, drivers, aplicativos, etc) se instalará sem problemas no novo HD?
4- Uma vez instalado em outo HD, no mesmo notebook que comprei, o sistema funcionará normalmente?
5- Quantas vezes posso criar a imagem do sistema?
Digo que a Dell não muito clara nesses pontos porque no Dell Backup and Recovery vejo coisas do tipo: "Você deve criar backups do sistema regularmente". Como vê, não impõe limite ao número de backups do sistema. Mais adiante, em "Criando Mídia de Recuperação do Sistema" diz que "O Dell Backup and Recovery permite restaurar o computador e os dados em caso de falha. Os Discos de recuperação criados com o aplicativo podem ser usados para reiniciar e restaurar o computador, ou para recriar os dados em outra unidade". Continuando diz lá: "Esta mídia irá conter apenas uma cópia do sistema operativo windows que foi fornecido com o seu sistema e os drivers que ativam os seus dispositivos. Esta opção só pode ser realizadauma vez e é recomendada apenas para usuários experientes". E mais, não estou confundindo backup de dados com backup de sistema.
Ficarei no aguardo de seus esclarecimentos, e espero que no futuro um outro funcionário da Dell não diga que suas informações estão incorretas.

pra mim mandaram do meu win7.....eu disse que tinha derrubado o meu note e tinha perdido meu hd....num demorou 7 dias recebia a midia....mas nem fiz drama nao....instalei o linux nele....windows nem de graca eu quero!

Gostaria de saber se as 5 perguntas foram respondidas pela Dell.
Estou com o mesmo impasse, e se for verdade, terei que acionar a Dell na justiça;
Aguardo a posição oficial da Dell.

Prezados,
Como descrito anteriormente, o Secure Boot é uma funcionalidade da Microsoft EXIGIDA à todos os fabricantes que vendem máquinas com Windows 8.
Porém, também é exigência da Microsoft que isso seja uma opção. Ou seja, que dentro da BIOS das máquinas haja a opção do usuário desabilitar o Secure Boot, assim retirando a necessidade de uma certificação UEFI inserida na máquina.
Vou poder instalar Linux na máquina? - Sim.
Vou poder trocar para outro sistema Microsoft? - Sim.
Existe uma chave injetada na placa? - Sim.
Existe uma chave injetada no processador e HD? - Não.
Se eu trocar de HD, terei problemas? - Não.
Mas quero fazer upgrade de processador!!! E agora? - Também não tem problemas :)
Existem alguns artigos disponíveis na mídia que descrevem todas as funcionalidades e todos os "Por Ques" de se utilizar essa tecnologia.
Recomendo pesquisar "O que é SecureBoot" no Google.
Caso tenham qualquer dúvida, fique à vontade para utilizar este espaço!

Renan, obrigado pela sua ajuda em esclarecer esta dúvidas dúvidas.
Porém continuo com dúvidas:
Conversei ontem com o suporte da Dell via Chat (Adriano_B) e hoje por telefone com Luciane Schell da Silva (Especialista em Atendimento ao Cliente) e os dois garantiram que eu não poderei colocar um SSD como boot no equipamento. A estória é a seguinte:
Comprei um XPS 8500 (desktop) com um HD de 2TB e com o windows 8 pré-instalado pela Dell.
Como tenho um SSD da Kingston, queria colocar o SSD como "HD" de boot ao invés do HD de 2TB, então criei a mídia de recuperação em DVD, coloquei o SSD, mudei a opção de UEFI e tentei criar o novo "HD" de boot no SSD usando a mídia de recuperação. Não consegui porque o instalador requer um HD de 2TB e não aceita instalar no SSD, embora reconheça-o. A recuperação foi cancelada.
Se eu mantenho o HD de 2TB, o instalador começa a fazer a instalação, sem perguntar, no HD de 2 TB e ignora o SSD.
Eu não quero tirar nada do equipamento, só quero colocar o SSD como disco de boot usando o mesmo Windows 8 que veio pré-instalado. Até agora não obtive resposta do suporte da Dell e estou acertando com a Luciane(Dell) a devolução do equipamento porque não fui avisado desta restrição no ato da compra por telefone.
Se puder me ajudar, agradeço, pois a devolução demora cerca de 20 dias.
