Can I use PowerPath for Linux (core 2.6) for VMware vSphere?

I'm really confused.
On one hand, some say that license is not free and if you need free PowerPath than use CD kit that is shipped with CLARiiONs.
On the other hand, there is no PowerPath for VMWare in my CD Kit and I have only PowerPath for Linux version 2.6 (the same core as ESX4.0 has).

Can I use the PowerPath which was shipped with ESX or I must use downloaded version of PowerPath for VMWare (PowerPath/VE 5.4.0)?
If I use downloaded version, do I need to by license or it is free?

for vsphere ent plus you need powerpath VE .

Other versions of vsphere 4 do not support other multipath software
