Noise when tilting and can't shut down

My new XPS15 makes noise when I tilt it, like if the (processor) fan is touching something.

My second problem is that I can't shut down the laptop. When it's off it imediately reboots again..

I'm close to just send this thing back (if I should, what's the best way for that?)
