has anyone ran into this scenerio before? going through the logs it seems like SPB saw the drive as failed but SPA still saw the drive as online thus preventing the HS from kicking in, I also try to do a manual proactive copy but that would not start either. Finally I had to just pull out the bad drive for the HS to initialize.

There have been changes in recent revs of Flare for dealing with drive failures, some of them in this very area (bad to one SP, good to the other) I suggest either you search PRIMUS or simply submit this as a SR so Support can determine if you are on the right level of code. That is also the first step in an RCA.
