should dell replace my operating system??

I have a XPS 8300 that I believe came with windows 7 and that I upgraded to windows 10 for free when Microsoft was making that offer.  When I bought the computer I did not receive any software disc.  The hard drive has failed and I do not have any type of back up disc with the operating system on them.  Given that I don't and that I was on windows 10 I feel that dell should provide me with a windows 10 OS, since as best i know I can't get the free upgrade if they provide me with windows 7.  Is this reasonable?   I have contacted Dell a few times about sending me a disc/thumb drive with the OS on it, but I keep getting the run around....call Microsoft, you want to buy a new OS?, you want us to repair the hard drives, etc.

 

any suggestions??

2. Good. Then that Windows-7 key will again work for a clean/fresh install of Windows-10. And, it will Activate as legit.

When you install Windows 10 for the first time, your systems hardware profile (motherboard details) are registered with a Microsoft Product Activation Server and you are given the green light for Product Activation. Should you ever clean install Windows 10 on that hardware you can skip the entry of the Product Key during installation (Windows 10 Installation Media also accepts Windows 7 Product Keys) and select the correct Edition Windows 10 Home (for Windows 7 Starter, Home Basic or Home Premium Licenses) and Windows 10 Pro (for Windows 7 Professional or Ultimate Licenses). After the clean install, when Windows 10 is online, it will automatically contact the Microsoft Product Activation Server, which will recognise the System's Hardware Profile (motherboard details) and be given the green light for Product Reactivation. Note when making the Bootable USB the XPS 8300 has a Legacy Only BIOS (non-UEFI) so use the MBR Partition Scheme and NTFS file format otherwise you'll be unable to boot.
