Terms of Use

Welcome to the Dell EMC Community Site, a place where people can connect with others to find answers to questions about their Dell EMC products and services. The Dell EMC Community Forum (collectively, “the Site” or “the Community”) is operated by Dell EMC (collectively, “us”, “we” or “the Company”). By accessing or using our this Community Forum (the “Site”) or by posting on this site, you (the “User”) signify that you have read, understand and agree to be bound by these Terms of Use (“Terms of Use” or “Agreement”), whether or not you are a registered member of Dell EMC. We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these Terms of Use at any time with or without further notice. If we do this, we will post the changes to these Terms of Use on this page and will indicate at the top of this page the date these terms were last revised. Your continued use of the Community after any such changes constitutes your acceptance of the new Terms of Use. If you do not agree to abide by these or any future Terms of Use, do not use or access (or continue to use or access) the Community Forum(s). It is your responsibility to regularly check the Site to determine if there have been changes to these Terms of Use and to review such changes.

 

PLEASE READ THESE TERMS OF USE CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS. YOUR AGREEMENT TO THESE TERMS OF USE HEREAFTER BINDS ALL OF YOUR ACTIVITIES ON THE SITE.

This DELL EMC Support Communities Use Agreement (the "Agreement") provides important information about your use of the Dell EMC Support Communities site (the "Site").

IMPORTANT: SHOULD YOU CHOOSE TO ACCEPT THIS AGREEMENT, YOU MUST ACCEPT IT AS PRESENTED TO YOU, WITHOUT CHANGES. DELL EMC WILL ACCEPT NO ADDITIONS OR DELETIONS. At any time Dell EMC may change, add, or remove any part of this Agreement or any part of the services and features provided on the Site. If it does so, Dell EMC will update the Agreement here and may also post such changes elsewhere on the Site.

IF ANY FUTURE CHANGE IS UNACCEPTABLE TO YOU, IT IS YOUR RESPONSIBILITY TO CEASE FURTHER USE OF THIS SITE. YOUR CONTINUED USE OF THE SITE WILL ALWAYS INDICATE YOUR ACCEPTANCE OF THIS AGREEMENT AND ANY CHANGES MADE TO IT AT ANYTIME.

So long as you comply with this Agreement, Dell EMC grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Site.

In addition to the terms and conditions in the Agreement, all use of the Site is governed by the Dell.com Terms of Use. In the event of any conflict between this Agreement and Dell.com Terms of Use, the terms of this Agreement will govern.

Views expressed on the Site are not endorsed by Dell EMC.

Dell EMC does not pre-screen information submitted by users of the Site ("Submissions"). Dell EMC retains the right, but not the responsibility, to edit or remove any Submission, including those deemed by Dell EMC to violate the Agreement. Dell EMC will make good faith efforts to investigate allegations that Submissions violate the Agreement but (a) makes no warranty to you that it will edit, remove, or continue to permit the display of any specific Submission, whether or not subject to such allegations, and (b) will have no liability whatsoever for editing, removing, or continuing to permit the display of any Submission.

 

Dell EMC Involvement

Dell EMC may respond to questions but does not formally provide technical support on the Site. Any information that is provided by Dell EMC or Dell EMC employees is offered on an "AS IS" basis without warranties of any kind.

Dell EMC may offer you benefits and award privileges for your participation and/or contribution to this Site. The benefits and privileges provided do not create an employee, agency or independent contractor relationship between yourself and Dell EMC, and you may not present yourself as a spokesperson for Dell EMC without written expressed and specific ability to do so as designated by and under the discretion of Dell EMC.

 

Privacy

Dell EMC may use "cookies" and other technologies to track user activity within the Dell EMC Support Communities. These technologies help us improve your experience and our products and services. Dell EMC’s use of this tracking information will conform to Dell EMC’s Privacy Policy.

Dell EMC Support Communities includes a "Private/Direct Message" feature which allows another Dell EMC Support Communities user to receive notifications when another user chooses to communicate through this feature with a member user directly. This feature allows for users to connect and, equally remove such user connections at anytime. Please note thee conversations will be actively monitored by the Dell team in order to ensure that only appropriate activities are taking place in these conversations

To submit information to the Site, each user must have a unique user name and password combination.

Please review Dell EMC’s Privacy Policy, which describes how Dell EMC collects, uses and protects your personal information. Dell EMC cannot and will not be responsible for any problems or liability that may arise if you do not provide accurate, truthful and complete information.

 

Registration Data & Account Security

In consideration of your use of the Site, you agree to (a) provide accurate, current and complete information about you as may be prompted by any registration forms on the Site (“Registration Data”); (b) maintain the security of your password and identification; (c) maintain and promptly update Registration Data, and any other information you provide on the Community, to keep it accurate, current and complete; and (d) be fully responsible for all use of your account and for any actions that take place using your account.

When you register for an account with the Dell Community, your information is used to create a member profile from which you may add or remove information. In many cases you will be automatically subscribed to the topic or a post you contribute to or create, which means you’ll receive email messages related to the topic or post(s) based on your activity. Please note you may update or deactivate such subscriptions through your member profile preferences page, accessible by clicking on your name/icon on the top right areas of most community pages, whilst you are logged in. Additionally, becoming a registered user enables you to communicate with other members through chat/and or Private messaging features. The content in these such messages, whether created by yourself or another community member, will be reviewed by Dell EMC Liaisons for accuracy and confirmation of compliance with the Code of Conduct as well as limiting the possibility of users contacting other users with unwanted information or requests. Repeated violations to the Code of Conduct identified in Private messages or chats will cause removal of your username and profile and all content to be marked as spam.

 

Proprietary Rights in Site Content

You acknowledge and agree that the Service and any necessary software used in connection with the Community contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that Content contained in private messages may be periodically monitored for your safety and protection of information as well as protection from spam or unauthorized communications.

Except for your own Member Content, you may not upload or republish content from any Internet, Intranet or Extranet site or incorporate the information in any other database or compilation. Such unauthorized use may violate applicable laws including copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated herein, nothing in these Terms of Use shall be construed as conferring any license to intellectual property rights, whether by implication or otherwise. This license is revocable at any time without notice and with or without cause.

 

No Automated Querying

No one may send automated queries of any sort to the Community or any related redemption site(s). This includes without limitation: (a) using any software that sends various queries to the Site to determine how it “ranks” the Search Results for various queries; (b) “meta-searching” the Site; or (c) using any high volume, automated, or electronic means (including without limitation robots, spiders, scripts, or other automatic devices) to access the Site or the Company’s systems or to monitor or copy the Site or any search results generated (d) utilizing the internal boards or email system to promote your product or company or any other Website.

Further, links that connect to commercial websites will not be considered unauthorized solicitations if the link(s) or the website(s) content appears to be intended as a means of solution or part of an “affiliate” program as determined by Dell Technologies at its sole discretion.

 

Eligibility : TechExperts program

The TechExperts® and Rockstar® reward programs are void where prohibited by law. While all registered Community users are eligible to earn points and rank up, not all users are eligible to redeem said points for rewards. TechExperts and Rockstars® may be required to sign a Non-disclosure agreement, subject to enforcement by applicable legal body, dependent of country.

The Community is intended solely for users who are thirteen (13) years of age or older. Any registration by, use of or access to the Site by anyone under 13 is unauthorized, unlicensed and in violation of these Terms of Use. By using the Service or the Site, you represent and warrant that you are 13 or older, and that you agree to and to abide by all terms and conditions of this Agreement.

 

User Conduct

You represent, warrant and agree that no materials of any kind submitted through your account or otherwise posted, transmitted, or shared by you on or through the Dell EMC will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain libelous, defamatory or otherwise unlawful material.

Member Content Posted on the Site

You are solely responsible for the photos, profiles (including your name, image, and likeness), messages, notes, text, information, advertisements, listings, and other content that you upload, publish or display (hereinafter, “post”) on the Site, or transmit to or share with other users (collectively the “Member Content”). You understand and agree that Dell EMC may review the Site and may delete or remove (without notice) any Member Content in its sole discretion, for any reason or no reason, including Member Content that in the sole judgment of the Company violates this Agreement or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of users or others.

 

Sharing Content

You acknowledge and agree that your use of the Share function and all links and/or Member Content shared is subject to, and will fully comply with the user conduct rules set forth above and the other terms and conditions set forth in these Terms of Use.

 

Reporting Copyright and Other Intellectual Property Violations

Dell EMC abides by all relevant copyright laws. We review all claims of copyright infringement, as well as other intellectual property violations, we receive. We will remove all content deemed to have been posted or distributed in violation of any such laws.

To report such a violation, please provide Company with as much detail as possible, including the following:

  • Information about the copyrighted work: description, information about where the work is protected, information about the current owner of the work, the physical or electronic signature of the copyright owner or a person authorized by the copyright owner to act on its behalf;
  • Information about the allegedly infringing work: description of the infringing material and any other information necessary to assist the Company in locating the allegedly infringing work;

 

Disclaimers

Although we provide rules for user conduct and postings, we do not control and are not responsible for what users post, transmit or share on the Site and are not responsible for any offensive, inappropriate, obscene, unlawful or otherwise objectionable content you may encounter on the Site or in connection with any Member Content or Third Party Applications, Software or Content. The Company is not responsible for the conduct, whether online or offline, of any user of the Site.

Dell EMC Services may be temporarily unavailable from time to time for maintenance or other reasons. Dell EMC assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, User communications. Dell EMC is not responsible for any technical malfunction or other problems of any telephone network or service, computer systems, servers or providers, computer or mobile phone equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any Site or combination thereof, including injury or damage to User’s or to any other person’s computer, mobile phone, or other hardware or software, related to or resulting from using or downloading materials in connection with the Web and/or in connection with the Site. Under no circumstances will Dell EMC be responsible for any loss or damage, including any loss or damage to any Member Content or personal injury or death, resulting from anyone’s use of the Community, any Member Content posted on or through the Site or transmitted to Users, or any interactions between users of the Site, whether online or offline. Dell EMC does not endorse any illegal or subversive activities that may be mentioned by Members of the site.

Dell EMC reserves the right to change any and all content used or contained on the Site and Applications offered through the Site at any time without notice. Reference to any products, services, processes or other information, by trade name, trademark, manufacturer, partner, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof, or any affiliation therewith, by Company.

 

Chatbot Queries

Dell EMC may enable third-party users deemed suitable to do so, to earn rewards for answering posts and questions. You may be contacted by a Chatbot in order to initiate the process, and which will ask for your service tag information. Please only provide this information to a Dell agent, easily recognizable on the Community as their usernames will contain “Dell” in it, or from the Dell-Cares bot which is enabled by Dell EMC to gather this information under strict privacy and security guidelines. This information will enable Dell EMC to answer your query faster as in some cases it allows your query to be routed to a Dell agent or a recognized and qualified contributor to the community.  Should you require assistance locating your service tag number, we encourage you to watch this video.

 

Termination

Dell EMC may terminate your membership, delete your profile and any content or information that you have posted on the Site or through any Application and/or prohibit you from using or accessing the Site (or any portion, aspect or feature of the Community) for any reason, or no reason, at any time in its sole discretion, with or without notice, including if it believes that you are under 13.

 

Indemnity

You agree to indemnify and hold the Company, its subsidiaries and affiliates, and each of their directors, officers, agents, contractors, partners and employees, harmless from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable attorney’s fees, arising out of or in connection with any Member Content you post or share on or through the Site (including through the Share Service), your use of the Site, your conduct in connection with the Site or the Site or with other users of the Site, or any violation of this Agreement or of any law or the rights of any third party.

 

Submissions

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information about the Site (“Submissions”), provided by you to Dell EMC are non-confidential and shall become the sole property of Company. Dell EMC shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

 

Definitions and Constructions

Unless otherwise specified, the terms “include”, “including”, “e.g.,”, “for example”, and other similar terms are deemed to include the term “without limitation” immediately thereafter. Terms used in these Terms with the initial letter(s) capitalized will have the meaning attributed to them in these Terms.
