XPS 13 Ubuntu, lots of issues (fan never shuts off, speaker static)

I just received my XPS 13 Ubuntu Developer Edition and noticed quite a few issues within the first 5 minutes. It's a pretty bad experience, and I'm about to return the item for a full refund. I'm not interested in investing a lot of my time fixing something that should have been addressed before the item shipped.

1) The fan always stays on using the default factory ship settings. The vents are not obstructed and do not appear to be damaged. The fan remains on even if I'm not running any applications. I can reboot and all I hear is the fan. It never shuts off even after 30+ minutes. The ambient temperature is 65 F.

2) Playing any kind of audio, I hear lots of static from the speakers. Running the audio test on the ubuntu system panel, I hear the same static. I didn't make any modifications.

I tried upgrading to ubuntu 14.04 and both issues persist.
