Based on what you've written it sounds like you are backing up a CIFS share from a remote system, is this correct? VSS does not support creating snapshots for network paths so any open files on a remote CIFS share will not be backed up. Best practice is to back up shares directly from the source if possible (using the client agent if the share is on a remote file server or NDMP for NAS devices).
