Ship With toner cartridge

Hi, Just after a quick bit of advice.

I've purchased a magenta cartridge for a 1350cnw from an ebay supplier which was advertised as High Capacity but unboxed.

The cartridge I received was not marked with High Capacity nor Standard Capacity but was marked as Ship-With on the label. It also had no tape seal and traces of toner where the seal should be

Would I be correct in assuming this has been taken from a new printer and contains less toner than even a Standard Capacity cartridge.

I have contacted the seller and basically they are messing me about.
