Issue with lattitude D820 battery

Ok have an issue with a d820 that has managed to confuse me.  Here is the breakdown.  We have 2 new batteries that both show the same issue.  You can put them in the system hooked up to a power supply, boot to bios screen and go to the battery section where you can see the charge status.  Both show charging from 0%.  They will charge at a normal rate until about 37-40% then they jump to 100% charged.  If you remove power the battery will drop to 0 and system will shut down within 2 min.  This occurs even if you leave the system on power overnight. 

Where it gets interesting is that after replacing the 1st battery it was assumed that this was an issue with the charging system of the laptop so the motherboard was replaced..  However we are having the same issue in the system with the new motherboard.  It does not matter what power supply we have it plugged into, it does the same thing.

Is there some obscure thing that the CPU does for the charging circuits?  That is about the only thing we have not replaced at this point.  Or is it more possible that I have 2 batteries, 1 about 1.5 months old and one less than 2 weeks, that both show the same issue.

Dell diagnostics test the system board and battery as passing.  Any suggestions on something to try next?  Any ideas on what might be going wrong?

Are these Dell batteries or third-party?
