Buying Dell OEM Windows 7 disk from Ebay

Hi, I was wondering if it is legal or not to buy the Dell OEM Windows 7 disk from Ebay. I am currently running XP and would like to upgrade using to Windows 7. Do I need a COA in order to install the Dell OEM Windows 7 dvd? I am running a Dell Optiplex GX620.

It is not illegal to "buy" the disk on eBay, it is illegal to "sell" the disk on eBay ... without hardware.  eBay allows sale of OEM disks as long as it includes some hardware, although it should technically be the original hardware, namely the computer it was sold with.  OEM software can only be installed on the original computer ... the key is NOT valid on any other system.  In order to install/use Windows 7 on your GX620, you must purchase a full version of Windows 7.

The guy says he is selling it with some hardware from the original machine to comply with Ebay's standards. He also "claims" that it's an unopened unused disk.

As was said in a previouos post....

It would only be legal to use it on the machine it was sold with. If he is selling the hardware with it to make the sale legal, you still need to consider that for you to be legal, you'd have to install it on the hardware from the original machine.... Installing it as an upgrade on your OptiPlex would violate the Microsoft EULA.
