Dell Backup will not help you with windows 10. It might not be installed or work in windows 10. Backup your files by copying to external media and ext hard drive just in case the upgrade has problems. Make a system image on external hard drive and recovery disks in case you have to return to windows 8.1. Factory Reset will not work after the upgrade. System image utility is on the File History page in Control Panel. Even better--wait a while after win 10 is released to see what problems crop up before deciding to upgrade. We have a whole year to decide to accept the free upgrade. 

How did you reinstall windows 8.1 when there are no installation disks? If you reset to factory settings, you don't need to reinstall dell backup. Do all the windows updates--there will be tons of them. Keep going back to windows update until it says No more updates.

I reinstall Windows 8.1 unpacking the iso file downloaded at microsoft.com in the hdd.
I don't need to type the OEM key as it is read automatically within Windows setup process, as you may know. I need to do this as my generated Dell recovery USB did not boot :emotion-6:
Run the setup and 8.1 was overinstalled correcting previous issues with Registry.

If I can't do nothing to have Dell Backup and Recovery back, which is the best method to get rid of Dell Recovery partition as it is useless now (at least I can have 7Gb back).

I've uninstalled Dell Backup & Recovery, boot, install again.

Same error. Stuck.

Seems Dell cannot manage an OS upgrade. The same will happen with Windows 10.

Shame. Poor support and development.

Factory error means your system partitions have changed and your recovery partition is corrupt. This is due to the faulty deployment of Windows 8.1 via the Microsoft Store and you should clean install Windows 8.1:

I have same problem. New XPS 8700 that I have spent more time on it than it has for me.  Problems with orange power light out of box see other forum discussions.  Windows update rendered recovery and backup non functional.  Update produced above message.  Numerous other BSODs Netios.sys etc

No Events found!
