Even expired support services (warranty contract), you can still download firmware updates. If the server is at its end of service life, engineering will not be releasing new firmware updates. Speaking of end of service life, there is no article stating specific dates, usually 5 years from its release date.
So to answer your question, are you permitted, yes you are. Newer versions, depends on it's EOSL on engineering release. But you still permit to download existing most recent firmware updates.
I probably should have mentioned this in my previous post, but I was asking because most if not all downloads (such as this) said "By downloading, you accept the terms of the Dell Software License Agreement." The first agreement listed in the linked page is the End User License Agreement, which states:
2.2. Except as otherwise permitted by this EULA or by mandatory law (meaning a law that the parties cannot change by contract), You must not, and must not allow Your Permitted Third Parties, to do the following:
[...] C. Download Updates from Licensor or an authorized provider unless You have a valid support agreement; D. Install Updates on Enterprise Products (e.g., server, networking, storage, integrated solutions, and data protection appliances) that have gone end of service life unless Licensor otherwise agrees in writing; [...]
I interpreted it to mean that I am not permitted to download newer versions of software (i.e. BIOS, firmwares) from "Drivers & Downloads" if my system has expired support services, and that I am not permitted to install said software if my system reached the end of service life.
However, this may have been a misunderstanding on my part, but please correct me if this isn't.
I might need to get back to you on the EULA statement. At the moment, if you need to update your PE2950 BIOS version 2.3.1, please proceed to download the file and update it.
I've tried to reach out to departments that could verify some information that is needed for the statement you asked on. But we need information about yourself in order for me to proceed submitting a ticket. Would you mind sending me a PM. I'll follow up with you in PM.
