You can not delete this file as long as Windows is running (and using the file). If you do manage to delete it, Windows will recreate the file when it is needed again.
You can empty its contents by Clearing your History.
You might want to think twice before applying the fix in that link. It states it will remove all the index.dat files. If it happens to remove the index.dat file for PCHEALTH, your System Information (msinfo32) tool will be crippled.
joe 53 is correct. If you're intent on removing your index.dat files you need to make that one a read only file before you clean them. To do that do the following: click on start and then double click on my computer, your hard drive(local disk), the windows folder. Scroll down to the PCHEALTH folder and double click on that. Then double click on HELPCTR and then OfflineCache. Right click on the index.dat file and click on properties. Check the box that says read-only and then click on apply and ok. The procedure outlined in TweakXP will delete all index.dat files except that one. After deleting the files go back and remove the check.

Cleaning your history does not clean the index.dat files. You can use the procedure listed in this URL:
