Dell Technologies Terms of Use for Ratings and Reviews
Scope
These Terms of Use for Ratings and Reviews and Questions and Answers (the “Terms”) govern your conduct associated with the online Customer Ratings and Reviews and if applicable Questions and Answers options offered by Dell (the "Review Options").. With respect to the Review Options, these Terms supplement Dell's Privacy Policy and other online policies, terms and conditions. To the extent of any conflict between these Terms and any provision of any generally applicable Dell policy or terms and conditions, these Terms shall control with respect to the Review Options. Dell may change these Terms from time to time. General information on Dell’s ratings and reviews standards and procedures is available on your local Dell website if and when products are advertised for direct purchase by consumers on the subsite for each eligible product (the “Ratings and Reviews Information”).
Your submission of Content
Representation and Warranties. By submitting any content to Dell via the Review Options (the “Content”), you represent and warrant that:
• you are the sole author and owner of the intellectual property rights thereto;
• all "moral rights" that you may have in the Content have been voluntarily waived by you;
• all Content that you post is accurate;
• you dispose of full legal capacity and are entitled to grant to Dell the rights as described in these Terms; and
• use of the Content you supply does not violate these Terms and will not harm and/or cause damage to Dell and/or any third party.
Consequences of your submission of Content. You acknowledge that you, not Dell, are solely responsible for the Content you submit as part of the Review Options. When you submit Content, it may be publicly accessible, along with your profile name and uploaded photo(s), and other information you choose to include in your Content. You hereby agree that the Content may be used by Dell for commercial purposes, including but not limited to advertisements, promotions or marketing materials. Dell reserves the right to publish reviews once the total number of reviews is equal to or greater than 10 for each product.
Local Language Requirement. Your Content must be in local language or in English Dell may reject or remove any Content that does not meet this requirement.
Content you shall not submit
You shall not submit any Content:
• that is known by you to be false, inaccurate or misleading; or
• that infringes any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy; or
• that violates any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising); or
• that is, or may reasonably be considered to be, defamatory, libelous, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual and/or entity; or
• on behalf of any merchant or manufacturer, or for which you were compensated or granted any consideration by any third party; or
• that includes another party's personal information (including personal information about Dell employees or employees of a Dell subcontractor) or that references other web sites, addresses, email addresses, contact information or phone numbers; or
• that contains any potentially malicious software or files; or
• that does not relate to the product or service for which you are reviewing.
• that suggests or contains evidence of violence to a child, child pornography, pornography, serious injury to/death of a child or death of an adult;
• that references something about the product or its use that is potentially unsafe (with no significant harm actually having occurred)
• that contains statements that can be construed as soliciting or providing medical advice (the type a medical doctor or physician might provide)
• that mentions an error (e.g. typo or grammatical errors) found on the product listing or website vs. what they actually received in their order
• that contains websites, hyperlinks, URLs, etc. that do NOT belong to Dell’s website or that otherwise direct customers to third party content
• that’s made even if you have yet to make a purchase or you have no experience with the specific product or Dell
• that contains tags that are clearly negative in the 'pros' or clearly positive in the 'cons,'
• that states or implies that you are under the age of 13
• that already exists as a review
• that appears to have been submitted as a test
• that is found to contain any form of an advertisement
Dell’s Use of your Content
Dell’s Use of Your Content. All Content that you submit may be used by Dell at its sole discretion. Dell reserves the right to pre-screen the Content which you have submitted in accordance with the Ratings and Reviews Information. Dell does not alter content in any way, nor do we allow you to alter submitted content unless such right is granted by applicable regulation (e.g. GDPR or other applicable privacy regulation). Any piece of content that is published to the website appears as it was originally written, including grammatical errors. The Content that you submit shall not be subject to any obligation of confidentiality on the part of Dell, its agents, subsidiaries, affiliates, partners or third -party service providers and their respective directors, officers and employees.

Data Privacy
With regard to any personal information submitted with the Content, Dell will collect, process, use, protect and share the information in accordance with Dell’s Privacy Policy of the Dell contracting entity as defined below.
By submitting your phone number and/or e-mail address in connection with your question, answer or review, you agree that Dell and its third-party service providers may use your phone number and/or e-mail address to contact you in connection with your question, answer and/or review and for other administrative purposes.
General
Survival. If at any time, any provision of these Terms shall be or shall become illegal, invalid or unenforceable in any respect, the legality, validity and enforceability of the remaining provisions of these Terms shall not be affected or impaired and shall continue to be in force as if such illegal, invalid or unenforceable provision was severed from these Terms.
Dell Contracting Entity. Your Dell contracting entity with regard to these Terms is the local entity responsible for the website you are accessing when participating in the Review Options or the contracting entity of your order if a Ratings and Review option is offered by email.
Governing Law for Ratings and Reviews. For Ratings and Reviews, these Terms shall be governed by the laws of the jurisdiction that governs the terms under which you purchased the product or service you are rating and/or posting a review about if not defined otherwise in these Terms.
Governing Law for Questions and Answers. For the Questions and Answers Service, these Terms shall be governed by the laws of the country at which the website via which you post your question is aiming (for example French law, if you post questions via the Questions and Answers Service available on dell.fr or German law, if you post questions via the Questions and Answers Service available in Germany on dell.de).
