XPS HDD died need help!

My XPS 8500 HDD die on me today.(I'm not a expert on computers but I think it die because of this screen.)

Now i'm thinking of buying a new HDD hopping it will work again. My problem is i don't have a hard copy of window 7 it didn't come with my pc when it was purchased two years ago. However I did an upgrade to window 8 for $14.99 and i added money to buy a hard copy of the upgrade version CD. My question is if i install my Window 8 upgrade cd on my new HDD will it work? Do i need to pay for another copy of windows for a new HDD? Is there any ways for me to restore the data on my old HDD? Or anyone know how to fix my HDD problem?

Let me suggest you first boot to your Dell drivers and utilities disc and run the Dell diagnostics to verify your hard drive has failed. 

To test your hard drive using your Dell Drivers and Utilities disc:
1. Reboot your system. When you see the Dell logo, hit F12 to enter the boot menu.
2. Insert the Dell Drivers and Utilities disc in your CD/DVD drive.
3. Pick the option to boot from the CD/DVD drive.
4. You will be prompted to hit any key to continue booting from the CD/DVD drive.
5. You will be prompted to hit 1 to run the Dell diagnostics. You may see two such menus.
6. Select Test System.
7. Select Custom Test.
7. Use the arrow keys or mouse to select your hard drive.
9. Click Run Tests.
10. Write down any error messages.
