Annie Plays Guitar’ XPS 15 Promotion Terms and Conditions November 2022

1.General conditions for participation

The Organizer of this Promotion is Dell Corporation Limited, 1st & 2nd Floor, One Creechurch Place, London, EC3A 5AF. The Administrator of this Promotion is Goat Solutions Limited, 30 City Road, London, EC1Y 2AB
The Promoter of this Promotion is influencer, ‘Annie Plays Guitar’ (@annieplaysguitar [Instagram.com]).
       a. This Promotion will be governed by these terms and conditions. By means of their registration to enter this Promotion, entrants confirm that they have read and agree to these terms and conditions.
       b. This Promotion is open to residents of the United Kingdom aged 18 and over only excluding employees and immediate relatives of employees of the Organizer, GOAT agency, their respective parent, subsidiaries or affiliated companies, the Promoter and any members of its immediate family, or any other person or entity professionally connected with this Promotion.
      c. Participation is permitted irrespective of purchase of a product/service. No purchase necessary.
      d. Only one entry per person, per email address is permitted.
      e. In case of non-compliance with any of these rules or any behavior that is considered defamatory, offensive or illegal the Organizer reserves the right to reject the entrant from the Promotion.
      f. The Organizer/Promoter takes no responsibility for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason. Proof of delivery of the entry is not proof of receipt.
      g. The Promotion is in no way organized, endorsed, or administered by, or associated with Instagram. You understand that you are providing your information to the Organizer/Promoter, and not to Instagram. The information you provide will only be used for the administration of this Promotion and in accordance with the Organizer’s policy. Instagram is completely released of all liability by each entrant in this Promotion. Any questions, comments or complaints regarding the Promotion must be directed to the Organizer and not to Instagram.
      h. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant or player. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Any potential winner may be required to show proof of being the authorized account holder.

2. Promotion details:

     a. The Promotion starts on 2nd November 2022 at 5pm GMT and closes at 5pm GMT on 7th November 2022.
 
     b. In order to promote the Organizer’s brand and its XPS 15 laptops, the Organizer wishes to run this Promotion to engage the Promoter’s Instagram followers. To enter the Promotion, entrants must be a follower of the Promoter’s Instagram account and will need to comment on the Promoter’s Instagram account why they wish to enter the Promotion within the Promotion start and close date. Entrants will be asked to provide their name and email address in order to participate (this data will only be used to contact entrants regarding their participation in the Promotion). The entrant guarantees that all information given is accurate.

3. Selection of Winners and Prizes:

     a. There will be one (1) winner in total. The winner will be the entrant whose entry is randomly selected from all the valid Promotion entries received within the Promotion start and close date.
     b. The winner will be announced on the Promoter’s Instagram account and on Dell’s UK page with first name and first capital of the surname no later than 28 days after the closing date of the Promotion. The winner will also be informed that they have won by the Organizer/Promoter via email (using the email address they have provided) or private message.
     c. The winner may be requested to provide further personal data in order for the Organizer/GOAT agency to contact them. In the event the e-mail/private message is returned as undeliverable, or a winner declines a prize, the relevant entry will be disqualified and a new winner will be randomly chosen. The Organizer/GOAT agency will fulfill shipment of the prize and will contact the winner to arrange an appropriate day and time for the delivery of the prize within a time period determined by the Organizer/GOAT agency.
     d. The winner will receive one (1) XPS 15 laptop.
     e. No cash alternative. Prizes are not transferable.
     f. Winners are responsible for all applicable taxes and expenses not specified in the prize description.

4. Your privacy and collection of personal data:

     By participating in the Promotion, entrants hereby agree to the Organizer collecting and using their personal information and acknowledge that they have read and accepted the Organizer’s privacy policy at:

     Organizer may transfer your personal information to affiliated companies outside the European Economic Area (EEA) such as Dell Inc. in the United States of America. By entering this Promotion, you will be deemed to: (i) have accepted these terms and conditions; (ii) warrant that any information you submit is accurate and relates only to yourself and (iii) if you are a winner, you agree to participate in any reasonable publicity arranged by Organizer including the publication of your name, photograph and a testimonial by you, in various media including on the Internet.

5. Limitations of Liability:

Organizer, Dell Inc. and its subsidiaries, and its agents are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (5) late, lost, undeliverable, damaged or stolen mail. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Promotion, provided this is done before the relevant closing date.

6. Governing law:

These Promotion terms and conditions will be governed by English law.
