Unless otherwise agreed upon in writing by you and Dell, the Commercial Terms of Sale govern the sale of Dell products, software, professional services and support and maintenance services to enterprise customers, the Cloud Subscriptions Schedule to the Commercial Terms of Sale applies to all cloud services offered to customers and the Outbound Embedded OEM Sales Agreement (below) governs the sale of Dell products, software, professional services and support and maintenance services to OEM customers purchasing from Dell for an OEM project.
